These Terms of Service ("Terms") govern your use of asmith.media, our WordPress plugins, our professional services, and any related digital products (together, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

The Services are operated by A. Smith Media, based in Frisco, Texas, USA.

Using the Services

You agree to use the Services only for lawful purposes and in accordance with these Terms.
You may not attempt to interfere with, reverse engineer, or bypass security of the Services.
You are responsible for the accuracy of any information you submit, including contact form submissions and billing details.

Purchases, Licenses & Billing

WordPress plugin licenses and professional service engagements are billed through Stripe. By purchasing, you authorize us (via Stripe) to charge the payment method you provide.

License terms: Pro plugin licenses are sold on an annual basis. Single-site licenses are tied to one domain; unlimited-site licenses may be used on any number of domains you own or operate.
License expiration: if your license expires, Pro features continue working for a 7-day grace period, after which Pro features are disabled. Free plugin functionality continues regardless.
Updates and support: annual licenses include plugin updates and support for the license period.
Taxes: prices are exclusive of any applicable taxes, which may be added at checkout.

Refund Policy

We offer a 30-day money-back guarantee on WordPress plugin license purchases. If you are not satisfied, contact us within 30 days of purchase for a full refund. Professional service engagements are governed by the refund terms in the individual statement of work.

Intellectual Property

All content on asmith.media — text, graphics, code not explicitly licensed as open source, and branding — is owned by A. Smith Media or our licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without permission, except:

Open-source projects published on our Labs pages are licensed under their stated licenses (e.g., MIT). The applicable license governs those projects.
Free WordPress plugins are licensed under GPLv2 or later, in line with WordPress.org requirements.

Services & Deliverables

Professional services (Google Ads management, SEO, custom websites, AI workflow integration, etc.) are delivered per the scope and terms in the applicable proposal or statement of work. Unless otherwise agreed:

Deliverables become your property upon full payment.
We retain the right to reuse general methodologies, tools, and know-how developed during engagements.
We may reference you as a client and describe the general nature of the engagement for marketing purposes, unless you opt out in writing.

Third-Party Services

Our Services rely on third-party providers (Stripe, Resend, Vercel, WordPress, Google, etc.). We are not responsible for the availability, accuracy, or content of third-party services.

Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.

Limitation of Liability

To the fullest extent permitted by law, A. Smith Media and its owners, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services. Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the amount you paid us in the twelve months preceding the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless A. Smith Media from any claims, damages, liabilities, and expenses arising from your violation of these Terms or your misuse of the Services.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Collin County, Texas.

Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date and, if changes are material, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
